General Terms and Conditions of Sale

GENERAL INFORMATION
These General Terms and Conditions of Sale (hereinafter referred to as "General Conditions") are drafted in compliance with the provisions of the Civil Code, Legislative Decree No. 70 of 09.04.2003 regarding the provision of information society services and electronic commerce. They govern the offer and sale of products through the website www.schroepfprofi.com (hereinafter referred to as the "Website").
The products marketed on the website www.schroepfprofi.com (hereinafter referred to as the "Products," also in the singular form) are sold by picotecno di Silvio Simonetti, with its registered office at Via Ruprecht 23, 39019 Tirolo (BZ), Italy, owner of the Website.

1. SCOPE OF APPLICATION
1.1 These General Conditions apply to and govern all sales contracts concluded through the Website of Picotecno di Silvio Simonetti, hereinafter referred to as "the Seller."
1.2 The General Conditions may be amended at any time; therefore, each Buyer is required to review them before making any purchase.
1.3 Each sale will be governed by the version of the General Conditions in effect at the time the purchase order is submitted.
1.4 The General Conditions apply regardless of the Buyer's nationality, provided that the delivery of the products takes place in one of the countries where the Website offers an online sales service, as specified inù
  Section 2, and that this country matches the country of the Buyer's registration.

2. SHIPPING COUNTRIES
2.1 Products may be purchased through the Website if shipping is requested to the following countries. For other countries, orders must be placed via email to verify delivery feasibility and related costs:

2.2 The Seller reserves the right to expand or limit the list of countries mentioned in Section 2.1.
2.3 Delivery is also available to the territories of the Republic of San Marino and Vatican City.
2.4 For all other non-listed countries, after payment for the goods, the customer must arrange for the collection of the goods either personally or by sending a trusted courier.

3. PURCHASES ON THE WEBSITE - RESTRICTIONS
3.1  The purchase of Products from the Website is limited to businesses or professionals (legal entities) to whom consumer code provisions, including the right of withdrawal, a 24-month warranty, exclusive
jurisdiction of the place of residence, etc., do not apply. Consequently, purchases by end consumers are prohibited. Since the Website cannot verify whether the Buyer is a private individual, the Buyer assumes full responsibility for the information provided during the purchase.
3.2 A consumer is defined as a natural person acting for purposes unrelated to their commercial, business, craft, or professional activities.
3.3 Purchases made through the Website imply the Buyer's full knowledge and unconditional acceptance of these General Conditions.

4. INFORMATION DIRECTLY RELATED TO THE CONCLUSION OF THE CONTRACT
4.1  To purchase online, the Buyer must complete the login form available on the Website.
4.2  The Buyer is prohibited from entering false or partially incorrect data; personal and email details provided must be authentic and not those of third parties and/or fictional.
4.3 By completing the registration form, the Buyer certifies under their sole responsibility:
i. the accuracy and truthfulness of the data required to activate the service;
ii. that they are at least 18 years of age;
iii. that they are acting as a legal entity (businesses or professionals).
4.4 Once the registration form is completed, the Buyer must fill out an electronic order form prepared by the Seller and submit it electronically, following the instructions provided.
4.5 To finalize each order, the Buyer must confirm the transaction involving the payment of the price for the Products in the cart; to this end, at the conclusion of the Product selection process and confirmation of the
Buyer's details, the Website redirects the Buyer to the bank's page managing the financial transaction.
4.6  Orders that do not record the corresponding financial transaction are automatically canceled.
4.7 The offer of Products through the Website constitutes a public offer under Article 1336 of the Civil Code; the correct completion and submission of an order through the Website therefore constitute acceptance of
this offer. Thus, the contract is concluded when the Seller becomes aware of the Buyer’s acceptance, formalized through the order form as outlined above.
4.8  The Seller reserves the right not to accept the order in case of non-authorization of payment by the relevant credit card processor.
4.9  The Buyer can monitor the status of their order at any time by contacting Customer Service via the dedicated section.
4.10 The Buyer must always retain the order number provided by the Seller, as this must be referenced in any communication with the Seller.
4.11 The languages available for concluding a sales contract through the Website are Italian, English, French, German, and Spanish.
4.12 The Buyer agrees, upon completing the online purchase procedure, to retain a copy of the General Conditions, which they will have reviewed and accepted as a mandatory step in the purchasing process.
4.13 In case of non-acceptance of the order, the Seller will promptly notify the Buyer via email.

5. PRODUCT SELECTION AND AVAILABILITY
5.1  The catalog of Products may be periodically updated by the Seller, who provides no guarantee regarding the continued availability of any given product in the online catalog. The Seller does not guarantee the
availability of all sizes/versions for each item/color listed.
5.2  Each product in the catalog is accompanied by a descriptive sheet outlining its main features. However, the images and colors of the Products on the descriptive sheets may not accurately reflect the actual
products due to the settings of the IT systems or devices used by the Buyer to view the Website. Published images are therefore indicative and subject to normal usage tolerances. For example, the model displayed online may refer to an earlier version, which could differ in design from the latest version.
5.3  If the chosen product, though selectable via the order form, is no longer available for purchase, the Seller will promptly inform the Buyer via email, proposing the termination of the sales contract and a refund of
the price, including any applicable shipping costs if already paid.

6. PRICES, PURCHASE CONDITIONS, AND PAYMENT METHODS
6.1  The selling prices are those published online at the time the order is finalized and include VAT, where applicable, based on the destination country of the Products. Prices are expressed in euros.
6.2 Prices listed in the online catalog are subject to change without prior notice. It is the Buyer’s responsibility to verify the final price before submitting a purchase order.
6.3  The Seller also reserves the right to apply different selling prices depending on the country of delivery of the Products.
6.4  Payment for Products can only be made using the following methods:
  • Credit card (Visa, Mastercard, American Express);
  • PayPal;
  • Stripe;
  • Bank transfer in advance.

7. DELIVERY METHODS, COSTS, AND OTHER CHARGES
7.1 The Products are delivered via contracted couriers directly to the Buyer at the shipping address specified during the order process.
7.2 The Website allows the Buyer to request delivery of the Products to an address other than their own, provided it is located within the Buyer’s country of residence as specified during login. In any case, it is the
Buyer's responsibility to provide all necessary details to ensure successful delivery (e.g., if delivering to a third party’s address, specifying the name on the doorbell/intercom where delivery should be made).
7.3 Shipping costs and methods may vary depending on the destination country and the delivery options chosen by the Buyer, as outlined in the table available on the Website.
7.4 These costs, along with any additional fees, are the Buyer’s responsibility. The total amount will be explicitly and separately indicated in the order summary before the Buyer submits the order, as well as in the
order confirmation email referenced in Article 3.
7.5 When the Products are handed over to the courier, the Buyer will receive a confirmation email from the Seller, specifying the courier's name and shipping details.
7.6 Delivery times for Products vary depending on the destination country, shipping methods chosen, and stock availability.
7.7 If the Products are in stock, delivery within Italy is expected within three working days. For international shipments, delivery times depend on the service provided by our trusted courier, BRT.
7.8 Not all shipping methods offered by our contracted courier, BRT, are available for all countries where online purchases are possible. For countries not listed in Section 2, the Buyer is responsible for arranging
collection directly from our warehouse.
7.9 Both in Italy and abroad, the delivery process includes a procedure where, in the event of the recipient's absence at the time of the courier's visit, a notice will be left. This notice will provide instructions and
contact details to schedule a second delivery attempt.
7.10 The Buyer can always check the status of their order by contacting Customer Service via email at: info@schroepfprofi.com
7.11 Delivery of the Products is considered completed when the Buyer, or a third party designated by them other than the carrier, takes physical possession of the goods. From this moment, as per legal provisions,
the risk of loss or damage to the Products not attributable to the Seller transfers to the Buyer.

8. BUYER'S OBLIGATIONS UPON DELIVERY
8.1 The Buyer acknowledges that collecting the Products is an obligation derived from the sales contract concluded with the Seller.
8.2 If delivery cannot be made due to the recipient's absence during the attempts scheduled by the courier's procedure, the package will be held in storage.
8.3 If the package is not collected within the timeframe specified in the courier's notice left with the Buyer, the package will be returned to the Seller.
8.4 In the situation described in Section 7.3, the contract will be considered terminated by law under Article 1456 of the Civil Code, upon simple notification by the Seller sent via email to the Buyer. Consequently,
the order will be canceled, and the Buyer will be required to reimburse the Seller for all incurred costs, including production costs, profit margin, unsuccessful delivery shipping costs, and the cost of returning the Products to the Seller.
8.5 In the event the Buyer refuses to accept the package, they will still be obligated to pay the full order amount, including production costs, profit margin, unsuccessful delivery shipping costs, the cost of returning
the Products to the Seller, and any other expenses incurred by the Seller due to the failed delivery. The Seller reserves the right to retain these amounts as compensation for damages incurred. However, the Buyer may request the product to be resent within no later than 6 months from the order date, subject to advance payment by bank transfer for the shipping costs.
8.6 The Seller reserves the right to reject orders from Buyers against whom the Seller has previously invoked the termination clause described in Sections 7.4/7.5 for failure to meet the obligation to accept delivery
of the Products.
8.7 Upon receiving the Products, the Customer is required to verify their conformity with the order, paying particular attention to ensure that:
  • The number of packages listed on the courier's document matches the number of packages delivered;
  • The packaging is intact, undamaged, and not tampered with.
    Any anomalies (e.g., tampering, damaged packaging) must be specifically noted in writing directly on the courier's delivery document, and the Buyer must refuse the delivery. Concurrently, the Buyer must report the issue to the Seller’s Customer Service via email at: info@schroepfprofi.com
    8.8 The Buyer is advised to sign the courier's delivery document only after performing the checks outlined in Section 8.7.

9. RIGHT OF WITHDRAWAL
9.1 The sale of products is reserved exclusively for legal entities. Therefore, the right of withdrawal provided for consumers does not apply to this sales contract.

10. WARRANTY
10.1  All Products sold through the Website come with a legal warranty of 12 months.
10.2   To avail of this warranty, the Buyer must report the defect to the Seller by contacting Customer Service through the dedicated section. The report must include a detailed and complete description of
the defects /issues encountered.
10.3  Regarding Section 8.2, Customer Service will respond to the Buyer’s communication by providing instructions for the shipment of the defective product and issuing the Buyer a Repair Authorization Code (RMA).
The initial shipping cost will be borne by the Buyer. If the product is verified to be defective during inspection, it will be repaired under warranty, and the Buyer’s incurred shipping costs will be reimbursed. Damaged components will be replaced with new ones.
10.4 The Seller reserves the right to request the Buyer to attach the purchase invoice or another document certifying the sale date to the product for which the warranty is being claimed.
10.5 The warranty does not cover defects or damages resulting from accidental events, the Buyer's liability, improper use of the Products not in accordance with their intended purpose, and/or normal wear and tear.

11. PRIVACY
11.1 User data is processed in compliance with Regulation 2016/679/EU (GDPR), as detailed in the privacy policy provided to the Buyer when completing the login form.

12.2 All communications under these General Conditions made via email will be sent to the address provided by the Buyer during login.

13. IMPROPER USE OF THE PRODUCT
13.1   To ensure proper functioning and maximum efficiency of the device, an annual maintenance check is essential. This helps identify and resolve potential issues before they can cause significant malfunctions.
The first annual maintenance check should be conducted 12 months after the purchase date of the product. Subsequently, the check must be carried out every year, adhering to a maximum tolerance of 90 days. Starting from the second year after purchase, the device must be shipped to our company for the annual maintenance check within the 90-day tolerance period. Our company assumes no responsibility for damages to persons or property resulting from the lack of an annual maintenance check.
13.2  Our company assumes no responsibility for damages or injuries resulting from improper use of the device for professional cupping therapy. The device is designed to be used exclusively by skilled and
qualified personnel. Therapists who have never performed cupping therapy are strongly encouraged to attend specific training courses to ensure safe and effective use of the device.
13.3   Training and Support: To facilitate the proper use of the device, our company offers online and in-person training courses. These courses are designed to provide the necessary knowledge and practical skills to
use the device safely and professionally. Our experts are available to guide you through every aspect of cupping therapy.
13.4   Disclaimer: By using the device without completing a training course provided by our company, the user accepts full responsibility for any consequences resulting from improper use. Our company disclaims all
liability for damages or injuries caused by non-compliant use.

14. APPLICABLE LAW AND JURISDICTION
14.1  The sales contract concluded under these General Conditions is governed by Italian law.
14.2  For any disputes arising in relation to the interpretation of the General Conditions or the execution of the contract concluded under them, the competent court will be the Court of Bolzano if the Buyer is a
consumer residing or domiciled in Italian territory.

If the Buyer does not reside or have a domicile in Italian territory, any disputes arising between the Seller and the Buyer regarding the interpretation of the General Conditions or the execution of the contract concluded under them will be exclusively under the jurisdiction of the Court of Bolzano.
